Please read these Terms carefully before using our Platform. By accessing or using Bertega, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Platform.

2. PLATFORM OVERVIEW
2.1 Marketplace Service
Bertega is an online marketplace platform that connects independent sellers with buyers. Bertega provides the technical infrastructure and services that enable sellers to list products and buyers to purchase them.
2.2 Role of Bertega
IMPORTANT: Bertega acts solely as a marketplace platform provider. We facilitate transactions between buyers and sellers but ARE NOT a party to the actual sale agreement between buyers and sellers. Bertega does not own, sell, resell, manage, offer, deliver, or control products listed by sellers.
2.3 No Liability for Transactions
BERTEGA HAS NO RESPONSIBILITY OR LIABILITY FOR ANY INTERACTIONS, TRANSACTIONS, OR DISPUTES BETWEEN BUYERS AND SELLERS. All transactions are directly between the buyer and the individual seller. Any issues, disputes, claims, or concerns regarding products must be directed to the seller from whom you purchased.

3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Age Requirement
You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Platform. By using Bertega, you represent and warrant that you meet this age requirement.
3.2 Account Registration
To access certain features, including making purchases or selling products, you must create an account. When registering, you agree to:
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. SELLER TERMS AND OBLIGATIONS
4.1 Seller Registration
To become a seller on Bertega, you must:
• Create a seller account and provide all required information
• Provide accurate business information, including shop name and contact details
• Agree to comply with all applicable laws and regulations
• Accept these Terms and any additional seller policies
4.2 Product Listings
As a seller, you agree to:
4.2.1 Quality Standards
• Use HIGH-QUALITY, PROFESSIONAL IMAGES for all product listings
• Provide clear, accurate, and complete product descriptions
• Include all relevant product specifications, dimensions, materials, and features
• Disclose any defects, damage, or imperfections
• Accurately represent the condition of items (new, used, etc.)
IMPORTANT: Bertega reserves the right to REMOVE ANY PRODUCTS that do not meet our quality standards, including listings with poor-quality, blurry, unprofessional, or misleading images.
4.2.2 Prohibited Content
You must NOT list products that:
• Are illegal, stolen, or counterfeit
• Violate intellectual property rights
• Are dangerous, hazardous, or recalled
• Violate any laws or regulations
• Are prohibited by Bertega’s policies
4.2.3 No Duplicate Listings
SELLERS ARE PROHIBITED FROM LISTING THE SAME PRODUCT MORE THAN ONCE. Creating multiple listings for identical products will result in:
• Immediate removal of duplicate listings
• Suspension of seller privileges
• Potential account termination
If you need to increase quantity, update the existing listing rather than creating a new one.
4.3 Pricing and Fees
• You are responsible for setting your own prices
• All prices must be clearly displayed and accurate
• You must honor the prices listed at the time of purchase
• Bertega may charge transaction fees or commissions as specified in seller agreements
4.4 Order Fulfillment
Sellers are solely responsible for:
• Processing orders in a timely manner
• Packaging products securely and appropriately
• Shipping products according to the timeline specified
• Providing tracking information when available
• Ensuring products arrive in the condition described
4.5 Customer Service
Sellers must:
• Respond to buyer inquiries promptly and professionally
• Address customer concerns and complaints
• Handle all disputes directly with buyers
• Maintain professional communication at all times
4.6 Seller Conduct
Sellers must NOT:
• Manipulate reviews or ratings
• Coordinate fake purchases or transactions
• Use the Platform for fraudulent purposes
• Harass, threaten, or abuse buyers
• Use buyer information for unauthorized purposes
• Engage in price manipulation or unfair practices

5. BUYER TERMS AND OBLIGATIONS
5.1 Making Purchases
When you make a purchase on Bertega:
• You are entering into a direct contract with the seller, NOT with Bertega
• You agree to pay the full purchase price, including shipping and any applicable taxes
• You authorize us to process payment through our third-party payment processors
• You are responsible for providing accurate shipping and billing information
5.2 Payment
• All payments must be made through Bertega’s approved payment methods
• You agree to pay all charges incurred on your account
• Prices are subject to change by sellers until you complete your purchase
• You are responsible for all applicable taxes
5.3 Product Information
• Product descriptions, images, and specifications are provided by sellers
• Bertega does not verify the accuracy of seller-provided information
• You should review product details carefully before purchasing
• Contact the seller directly if you have questions about a product
5.4 Communication with Sellers
• You may communicate with sellers through the Platform for legitimate purchase-related purposes
• You must not harass, threaten, or abuse sellers
• All communications must be professional and respectful

6. NO REFUNDS AND RETURNS POLICY
6.1 No Refunds
IMPORTANT: ALL SALES ON BERTEGA ARE FINAL. Bertega does not offer refunds for any purchases made through the Platform.
6.2 No Returns
BERTEGA DOES NOT ACCEPT RETURNS OF ANY PRODUCTS. Once a purchase is completed and the product is shipped, it cannot be returned to Bertega.
6.3 Seller Discretion
Individual sellers MAY choose to offer refunds or accept returns at their sole discretion. Any such policies are:
• Set independently by each seller
• Not guaranteed or enforced by Bertega
• Subject to the seller’s individual terms and conditions
• The sole responsibility of the seller to honor
6.4 Disputes with Sellers
If you have any issues with a product, including:
• Damaged or defective items
• Items not as described
• Missing items
• Quality concerns
• Any other product-related issues
YOU MUST CONTACT THE SELLER DIRECTLY. All product-related disputes must be resolved between the buyer and seller. Bertega is not responsible for mediating disputes or enforcing seller return policies.
6.5 Customer Support

However, customer support CANNOT process refunds, returns, or resolve product disputes. Our support team can only assist with technical platform issues and help facilitate communication with sellers.

7. PROHIBITED USES AND CONDUCT
7.1 Illegal and Criminal Activity
You expressly agree that you will NOT use the Platform for:
• ANY ILLEGAL, CRIMINAL, OR UNLAWFUL PURPOSES
• Fraud, scams, or deceptive practices
• Money laundering or financing illegal activities
• Trafficking in illegal goods or services
• Harassment, threats, or intimidation
• Stalking or invasion of privacy
• Any activity that violates local, national, or international laws
7.2 Platform Abuse
You must NOT:
• Attempt to gain unauthorized access to the Platform or other users’ accounts
• Use automated systems (bots, scripts, scrapers) without permission
• Interfere with the proper functioning of the Platform
• Upload viruses, malware, or other harmful code
• Spam, solicit, or send unsolicited communications
• Manipulate prices, reviews, or ratings
• Create fake accounts or impersonate others
7.3 Intellectual Property Violations
You must NOT:
• Infringe on any copyright, trademark, patent, or other intellectual property rights
• Sell counterfeit, pirated, or unauthorized goods
• Use others’ logos, branding, or images without permission
7.4 Consequences of Violations
Violation of prohibited uses may result in:
• Immediate account suspension or termination
• Removal of listings and products
• Legal action and referral to law enforcement
• Liability for damages and legal fees
• Permanent ban from the Platform

8. INTELLECTUAL PROPERTY RIGHTS
8.1 Bertega’s Intellectual Property
All content on the Platform, including but not limited to:
• The Bertega name, logo, and branding
• Website design, layout, and graphics
• Software, code, and functionality
• Text, images, and multimedia content created by Bertega
are the exclusive property of Bertega and are protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes, subject to these Terms.
8.3 User Content
You retain ownership of content you upload to the Platform (product listings, images, descriptions). However, by uploading content, you grant Bertega a worldwide, royalty-free, non-exclusive license to:
• Display, reproduce, and distribute your content on the Platform
• Use your content for marketing and promotional purposes
• Modify or adapt your content for technical compatibility
8.4 Seller Responsibility
Sellers represent and warrant that they have all necessary rights to list and sell products on the Platform and that their listings do not infringe on any third-party rights.

9. DISCLAIMERS AND LIMITATION OF LIABILITY
9.1 Platform “As Is”
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 No Warranty on Products
BERTEGA MAKES NO WARRANTIES, REPRESENTATIONS, OR GUARANTEES REGARDING:
• The quality, safety, legality, or authenticity of products listed by sellers
• The accuracy of product descriptions, images, or specifications
• The ability of sellers to fulfill orders
• The condition in which products will arrive
• Whether products will meet your expectations
9.3 Third-Party Sellers
YOU ACKNOWLEDGE AND AGREE THAT:
• All products are listed and sold by independent third-party sellers
• Bertega does not manufacture, inspect, or certify any products
• Bertega has no control over the quality, safety, or legality of products
• Sellers are solely responsible for their products and conduct
9.4 No Liability for Transactions
BERTEGA SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR EXPENSES ARISING FROM:
• Transactions between buyers and sellers
• Product defects, damage, or non-delivery
• Seller misconduct, fraud, or failure to fulfill orders
• Buyer disputes, chargebacks, or payment issues
• Any interactions between users
9.5 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERTEGA’S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO BERTEGA IN FEES DURING THE 12 MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL BERTEGA BE LIABLE FOR:
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Any damages resulting from your use or inability to use the Platform
9.6 User Responsibility
YOU ASSUME ALL RISKS ASSOCIATED WITH:
• Using the Platform and transacting with other users
• The quality, safety, and legality of products purchased
• Communication and interactions with sellers and buyers
• Payment processing and financial transactions

10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Bertega, its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Platform
• Your products, listings, or content (for sellers)
• Your transactions with other users

11. DISPUTE RESOLUTION
11.1 Disputes Between Users
All disputes between buyers and sellers must be resolved directly between the parties involved. Bertega is not responsible for mediating, arbitrating, or resolving user disputes.
11.2 Disputes with Bertega
For any disputes with Bertega:
11.2.1 Informal Resolution

11.2.2 Binding Arbitration
